Overview

This website is operated by W Concept LLC, a California limited liability company operating the FlowFLow brand in the United States (“FlowFLow,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) govern your access to and use of www.flowflowusa.com, including the website, content, features, customer accounts, and services offered through it, as well as your purchase and use of FlowFLow products (collectively, the “Services”).

By accessing or using the Services, creating an account, or placing an order, you agree to these Terms and to any policies incorporated by reference, including our Privacy Policy, Refund Policy, Shipping & Returns Policy, and applicable product warranty terms.

Please read these Terms carefully. If you do not agree to them, do not access or use the Services.

Our online store is powered by Shopify, which provides the ecommerce platform through which we offer our products.

Section 1 — Eligibility, Adult Use, and General Conditions

Age Requirement. FlowFLow products and Services are intended for adults age 18 and older. By using the Services or purchasing a FlowFLow product, you represent that you are at least 18 years old and legally capable of entering into a binding agreement.

Personal and Lawful Use. You may use the Services and products only for lawful, personal purposes. You may not use our products or Services for any illegal, unauthorized, fraudulent, or prohibited purpose.

Right to Refuse Service. To the extent permitted by law, we may refuse service, restrict access, suspend an account, or cancel an order where we reasonably believe there has been fraud, abuse, unlawful activity, unauthorized resale, misuse of promotions, or a violation of these Terms.

Section 2 — Product Use, Safety, and Wellness Disclaimer

Follow Product Instructions. FlowFLow products must be used in accordance with the applicable user manual, safety instructions, warnings, cleaning instructions, and other documentation supplied with the product.

Wellness Products. FlowFLow products are designed for adult personal and intimate wellness. They are not intended to diagnose, treat, cure, or prevent any disease, and information provided through the Services does not constitute medical advice.

Health Considerations. If you have a medical condition, are pregnant, use an implanted or electronic medical device, have unusually sensitive or injured skin, or have questions about whether a product is appropriate for you, consult an appropriate healthcare professional before use.

Stop Use if Necessary. Discontinue use if you experience pain, unusual discomfort, irritation, numbness, burning, injury, or another unexpected reaction.

Product-Specific Functions. Products may include vibration, suction, warming, microcurrent, or other functions. Each function should be used only on the body areas and in the manner described in the applicable product instructions.

This is especially important because your current manuals include product-specific safety requirements and restrict certain functions to particular areas of the body.

Section 3 — Product Information and Availability

Descriptions and Images. We make reasonable efforts to display product descriptions, photographs, specifications, dimensions, colors, functions, and other information accurately. Actual appearance may vary slightly due to lighting, screen settings, manufacturing tolerances, or reasonable product updates.

Availability. Products may be available in limited quantities and may be discontinued or become unavailable without notice.

Product Updates. We may make reasonable changes to product design, packaging, components, or specifications from time to time.

Individual Experience. Experiences with intimate wellness products vary. Product descriptions, reviews, educational materials, and marketing content do not guarantee any particular physical, emotional, wellness, or pleasure-related outcome.

Section 4 — Prices, Promotions, and Errors

Prices. Prices displayed on our U.S. website are in U.S. dollars unless otherwise stated and may change without notice.

Taxes and Shipping. Applicable taxes, shipping charges, and other fees will be displayed at checkout where applicable.

Promotions. Promotional codes, discounts, bundles, gifts, or special offers may be subject to expiration dates, quantity limits, exclusions, and additional conditions. Unless expressly stated otherwise, promotions may not be combined.

Errors. We may correct typographical, pricing, product-description, availability, or other errors. If an error affects an order you have already placed, we may contact you to correct the order or cancel the affected item and provide any refund required by law.

Section 5 — Orders, Billing, and Payment

Order Acceptance. Placing an order does not guarantee acceptance. We may cancel or decline an order because of product availability, payment issues, suspected fraud, pricing errors, shipping restrictions, regulatory requirements, or other legitimate business reasons.

Order Limits. We may limit quantities purchased per person, household, payment method, address, or order, including where an order appears to be placed for unauthorized resale.

Accurate Information. You agree to provide accurate and current contact, billing, payment, and shipping information.

Payment Processing. Payments are processed by third-party payment processors. By submitting a payment method, you represent that you are authorized to use it and authorize the applicable charges associated with your order.

Section 6 — Shipping, Delivery, and Order Privacy

Shipping Terms. Shipping methods, estimated delivery times, shipping costs, and procedures relating to delayed, lost, or damaged shipments are described in our Shipping & Returns Policy.

Delivery Estimates. Delivery dates are estimates unless expressly stated otherwise. Delays may occur because of carriers, weather, holidays, transportation disruptions, incorrect addresses, or other circumstances outside our reasonable control.

Address Accuracy. You are responsible for providing a complete and accurate shipping address. Contact us as soon as possible if you discover an error.

Discreet Shipping. Because FlowFLow sells intimate wellness products, we take reasonable steps to use discreet outer packaging and protect the privacy of your order. We cannot guarantee complete confidentiality once information is processed by third-party carriers, payment providers, or other parties necessary to complete your transaction.

Section 7 — Returns, Refunds, and Limited Warranty

Returns and Refunds. Returns and refunds are governed by our Refund Policy and Shipping & Returns Policy.

Intimate Products. Because our products are intimate personal wellness products, return eligibility may depend on whether an item has been opened, used, or had a hygiene or protective seal removed. Please review the applicable return policy before opening a product if you may wish to return it.

Defective or Incorrect Products. Products that arrive damaged, defective, or incorrect are handled separately from ordinary change-of-mind returns. Contact us promptly at info@flowflowusa.com if there is a problem with your order.

Two-Year Limited Warranty. Unless otherwise stated in the applicable product documentation, FlowFLow devices are covered by a two-year limited warranty from the original date of purchase against qualifying defects in materials or workmanship.

Warranty coverage does not ordinarily include normal wear and tear, misuse, failure to follow product instructions, accidental damage, improper storage or cleaning, unauthorized modification or repair, or damage otherwise excluded by the applicable warranty terms.

Nothing in our warranty terms limits consumer rights that cannot legally be waived.

Section 8 — Accounts

Account Responsibility. If you create an account, you are responsible for maintaining the confidentiality of your login information and for activity conducted through your account.

Accurate Information. You agree to provide accurate account information and update it where reasonably necessary.

Unauthorized Access. Contact us promptly at info@flowflowusa.com if you believe your account has been accessed without authorization.

Section 9 — Reviews, Feedback, and User Content

Your Content. If you submit a product review, photograph, comment, suggestion, feedback, or other content, you represent that you have the right to provide it and that it does not violate applicable law or another person's rights.

Permission to Use Content. By voluntarily submitting content for publication or promotional use, you grant FlowFLow a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and distribute that content in connection with operating, promoting, and improving our business and Services, subject to applicable law and our Privacy Policy.

Moderation. We may decline to publish or remove content that we reasonably determine is fraudulent, unlawful, abusive, misleading, infringing, or otherwise inappropriate.

Section 10 — Intellectual Property

Ownership. The website and its content, including text, photographs, graphics, illustrations, videos, logos, trademarks, layouts, product imagery, and other materials, are owned by or licensed to FlowFLow or its licensors and are protected by applicable intellectual property laws.

Limited Use. We grant you a limited, revocable, non-exclusive, non-transferable right to access the Services for personal, non-commercial use.

Restrictions. You may not reproduce, distribute, modify, sell, license, commercially exploit, or create derivative works from protected FlowFLow materials without prior written permission, except where permitted by law.

Section 11 — Shopify, Third-Party Tools, and Links

Shopify. Our online store is hosted through Shopify, which provides the ecommerce platform that allows us to offer products and Services to you.

Third-Party Services. We may use or provide access to third-party payment providers, shipping services, applications, analytics tools, social media platforms, or other technologies that we do not directly control.

Third-Party Terms. Your use of independent third-party services may be governed by their own terms and privacy policies.

External Links. Links to external websites are provided for convenience and do not necessarily constitute endorsement. FlowFLow is not responsible for the independent content, availability, privacy, or security practices of third parties.

Maude specifically identifies Shopify and third-party payment providers in its Terms, while Dame and Unbound maintain separate third-party tools/links provisions.

Section 12 — Privacy and Marketing Communications

Privacy. Personal information collected through the Services is handled in accordance with our Privacy Policy.

Transactional Messages. We may contact you regarding orders, payments, shipping, returns, warranty requests, customer service, account security, and other transactional matters.

Email and SMS Marketing. If you separately opt in, we may send promotional email or SMS communications. Consent to promotional SMS messages is not a condition of purchase.

Opting Out. You may unsubscribe from promotional emails using the unsubscribe link provided in the message. Where SMS marketing is offered, you may opt out using the instructions provided, including replying STOP where applicable.

Section 13 — Prohibited Uses

You may not use the Services to engage in unlawful or fraudulent activity; violate another person's intellectual property or privacy rights; submit false or misleading information; distribute malicious code; interfere with website security or functionality; attempt unauthorized access; collect personal information about others without authorization; spam, phish, scrape, crawl, or otherwise misuse the Services; or encourage another person to engage in prohibited conduct.

We may restrict or terminate access to the Services for violations of this Section.

Section 14 — Website Accuracy and Availability

General Information. Information on our website is provided for general informational purposes. We make reasonable efforts to keep information accurate but do not guarantee that all website content will always be complete, current, or error-free.

Availability. We do not guarantee uninterrupted or continuous access to the website. Portions of the Services may occasionally be unavailable because of maintenance, security, technical issues, or circumstances outside our reasonable control.

Corrections. We may correct errors, update information, or modify website content where reasonably necessary and permitted by law.

Section 15 — Disclaimer of Warranties

Website and Digital Services. To the fullest extent permitted by applicable law, the website and digital Services are provided on an “as is” and “as available” basis. We do not guarantee that the website will be uninterrupted, completely secure, or free from all errors or harmful components.

Product Warranties Preserved. This Section does not replace, disclaim, or reduce the express FlowFLow limited product warranty described above or any statutory warranty or consumer right that cannot legally be excluded.

This is one place where I would not copy Dame or Unbound word-for-word: both use broad Shopify “as is” language covering products, whereas FlowFLow's manuals expressly provide warranty protection.

Section 16 — Limitation of Liability

To the fullest extent permitted by law, W Concept LLC, FlowFLow, and their respective officers, employees, affiliates, agents, licensors, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from or relating to the Services, including lost profits, lost revenue, lost data, or lost business opportunities.

Some jurisdictions do not permit certain exclusions or limitations of liability. In those jurisdictions, our liability will be limited only to the maximum extent permitted by applicable law.

Nothing in these Terms excludes or limits any liability, consumer right, warranty, or remedy that cannot legally be excluded or limited.

Section 17 — Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless W Concept LLC, FlowFLow, and their officers, directors, employees, agents, affiliates, licensors, and service providers from third-party claims, losses, liabilities, damages, or reasonable costs arising from your unlawful use of the Services, material violation of these Terms, or infringement of another person's rights.

Nothing in this Section requires indemnification where it cannot legally be required.

Section 18 — Termination

Your Use. You may stop using the Services at any time.

Our Rights. We may restrict or terminate access where reasonably necessary because of a material violation of these Terms, fraud, abuse, unlawful activity, security concerns, or conduct that could reasonably harm FlowFLow, our customers, or third parties.

Survival. Terms that by their nature should survive termination, including intellectual property, payment obligations, disclaimers, limitations of liability, indemnification, and governing-law provisions, will remain effective.

Section 19 — Governing Law, Severability, and Waiver

Governing Law. These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where another law must apply.

Venue. Subject to non-waivable consumer rights and applicable jurisdictional requirements, legal proceedings properly brought in court will be brought in the applicable state courts located in Sacramento County, California, or the applicable federal courts in the Eastern District of California.

Severability. If any provision of these Terms is found invalid or unenforceable, it will be limited or severed only to the extent necessary, and the remaining provisions will continue in effect.

No Waiver. Our failure to enforce any provision does not waive our right to enforce it later.

Lioness likewise uses California governing law and a California court venue, which is a better model for FlowFLow than copying Dame or Unbound's New York provisions. 

Section 20 — Entire Agreement, Changes, and Contact Information

Entire Agreement. These Terms, together with our Privacy Policy, Refund Policy, Shipping & Returns Policy, applicable product warranty terms, and other policies expressly incorporated by reference, constitute the agreement between you and FlowFLow regarding the Services.

Product Instructions. Product-specific user manuals, warnings, and safety requirements also apply to your use of the applicable product.

Changes to These Terms. We may update these Terms from time to time to reflect changes to our products, Services, business practices, or applicable law. When we do, we will post the revised Terms and update the “Last Updated” date. Where required by law, additional notice will be provided.
